PMLN Seeks Appointment Of 2 NFC Members Declared Void By IHC

The appointment of 2 out of 5 members of the National Finance Commission has been challenged in the Islamabad High Court.

PMLN Leader and Former Federal Minister Khurram Dastgir Khan along with MNA Barrister Mohsin Shahnawaz Ranjha filed the petition challenging the appointment.

Islamabad High Court Judge Mian Gill Hassan Aurangzeb heard the plea. The writer petition has named the President, the cabinet, secretary Law, secretary treasury and SAPM Finance Abdul Hafiz Sheikh as respondents.

The judge question censured the officials of the treasury and asked as to why did the finance ministry not submit its response to the petition. He directed the attorney General to appear in person in the next hearing and ordered the government counsel to submit response before next hearing. The ministry argued Two similar petitions are subjudice in two other courts.

Mohsin Nawaz Ranjha said members of the NFC can be appointed after consultation with the governors of all provinces. He maintained that the perspective of the provinces was ignored while accounting these members. This he did is illegal and unconstitutional. He pleaded that the High Court should render these appointments of 12th May void.

Ranjha said the subject included in the NFC conditions are beyond the jurisdiction of the commission. These matters can under the jurisdiction of the Council Of Common Interests and the ECC, he said. He argued that the article 160 had been violated with these appointments.

The court has set the next hearing for the case on 26th June.
